La ville de Lille a souhait\u00e9 que ce dispositif puisse \u00eatre exp\u00e9riment\u00e9 sur son territoire.<\/p>\n<p>Les loyers des baux d\u2019habitation pour les logements vides et meubl\u00e9s \u00e0 usage de r\u00e9sidence principale du locataire ainsi que les baux mobilit\u00e9s qui feront l&rsquo;objet d&rsquo;un contrat sign\u00e9 \u00e0 compter du <u>1<sup>er<\/sup> mars 2020<\/u> seront plafonn\u00e9s, sauf exception.<\/p>\n<p>Le plafonnement du loyer se combine avec <a href=\"https:\/\/www.pap.fr\/bailleur\/loyer-charges\/l-encadrement-des-loyers-a-la-relocation-reconduit-en-zone-tendue\/a16858\">l\u2019encadrement du loyer \u00e0 la relocation<\/a> qui lui s\u2019applique d\u00e9j\u00e0 dans toute <a href=\"https:\/\/www.pap.fr\/bailleur\/loyer-charges\/qu-est-ce-que-la-zone-tendue\/a19900\">la zone tendue<\/a> dont fait partie Lille. En effet, le loyer ne doit pas \u00eatre augment\u00e9 entre deux locataires, sauf exceptions.<\/p>\n<p>L&rsquo;encadrement des loyers s\u2019applique \u00e0<strong> Lille<\/strong> puisque la mairie en a fait la demande et que le gouvernement l&rsquo;a accept\u00e9e par <a href=\"https:\/\/www.legifrance.gouv.fr\/affichTexte.do;jsessionid=29614DCF40822FDF954EF8463C6EBD17.tplgfr32s_1?cidTexte=JORFTEXT000041460148&amp;dateTexte=&amp;oldAction=rechJO&amp;categorieLien=id&amp;idJO=JORFCONT000041459812\">\u00a0d\u00e9cret du 22 janvier 2020<\/a>, comme pour les villes de <strong>Lomme et Hellemmes.<\/strong><\/p>\n<p><u>La date du 1<sup>er<\/sup> mars 2020 est d\u00e9terminante<\/u>\u00a0: Les contrats sign\u00e9s avant n&rsquo;auront pas \u00e0 respecter l&rsquo;encadrement des loyers,\u00a0m\u00eame si la remise des cl\u00e9s a lieu apr\u00e8s cette date. Il en va de m\u00eame lors de leur tacite reconduction.<\/p>\n<p>Les contrats de location \u00e0 usage de r\u00e9sidence secondaire, de logement de fonction ou de vacances (les locations saisonni\u00e8res) ne seront pas concern\u00e9s par l&rsquo;encadrement des loyers.<\/p>\n<p><strong>\u00a0<\/strong><\/p>\n<p><strong><u>Le fonctionnement de l\u2019encadrement des loyers \u00e0 Lille<\/u><\/strong><\/p>\n<p>L&rsquo;encadrement des loyers impose de ne pas d\u00e9passer un loyer plafond dit \u00ab\u00a0loyer de r\u00e9f\u00e9rence major\u00e9\u00a0\u00bb.<\/p>\n<p>Le loyer au m\u00b2 sera d\u00e9termin\u00e9 en fonction de plusieurs \u00e9l\u00e9ments\u00a0:<\/p>\n<ul>\n<li>L\u2019emplacement du bien<\/li>\n<li>Le type de location, non meubl\u00e9e ou meubl\u00e9e ;<\/li>\n<li>Le nombre de pi\u00e8ces principales ;<\/li>\n<li>L\u2019\u00e9poque de construction.<\/li>\n<\/ul>\n<p>Vous pouvez d\u2019ores et d\u00e9j\u00e0 vous connecter sur le <a href=\"https:\/\/encadrement-loyers.lille.fr\/\">site de la mairie de Lille<\/a>, afin de connaitre le montant du loyer plafonn\u00e9 pour votre logement.<\/p>\n<p>Vous seront alors communiqu\u00e9s\u00a0:<\/p>\n<ul>\n<li>un loyer de r\u00e9f\u00e9rence ;<\/li>\n<li>un loyer de r\u00e9f\u00e9rence minor\u00e9 de 30 % ;<\/li>\n<li>un loyer major\u00e9 de 20 % (Plafond \u00e0 ne pas d\u00e9passer).<\/li>\n<\/ul>\n<p>Les montants obtenus correspondent \u00e0 un loyer hors charges\/m\u00b2\/mois. Le loyer doit donc se trouver dans une fourchette comprise entre le loyer de r\u00e9f\u00e9rence minor\u00e9 et le loyer de r\u00e9f\u00e9rence major\u00e9.<\/p>\n<p><strong><u>Des sanctions en cas de non-respect de l&rsquo;encadrement des loyers<\/u><\/strong><\/p>\n<p>Pour \u00eatre mieux respect\u00e9 que lors de sa premi\u00e8re application de 2017, l&rsquo;encadrement des loyers sera assorti de sanctions.
